Apply for a certificate of no impediment
Service description
A certificate of no impediment to marriage certifies that there are no legal obstacles to an intended marriage. Whether such a certificate is required depends on the law of the country in which the marriage is to take place.
If you are a German citizen and wish to get married abroad, please check with the relevant foreign authority to see whether a certificate of no impediment to marriage is required and whether notarization is necessary. In some countries, in addition to the certificate of no impediment to marriage issued by the German registry office, a certificate from the German consulate is required. The certificate of no impediment to marriage is issued by the registry office in your place of residence in Germany, provided that there are no legal impediments to the intended marriage under German law. The above also applies to stateless foreigners, persons entitled to asylum, foreign refugees, and stateless persons who have their habitual residence in Germany.
If you are a foreign national and wish to get married in Germany, you must submit a certificate of no impediment to marriage issued by the country of which you are a national. This is a requirement under German marriage law. In this certificate, the competent authority in your home country must confirm that there are no legal impediments to the marriage under your home country’s law.
For countries that do not issue certificates of no impediment to marriage, you must apply to the President of the Higher Regional Court of Naumburg for an exemption from this requirement. The application must be filed with the registry office.Who should I contact?
The registry office of the German partner's place of residence is responsible for issuing a certificate of no impediment to marriage for Germans. As a foreigner, you can also obtain information there about the certificate of no impediment to marriage in your home country, which you must then obtain from your competent home authority.
